Apart from the light bars dimensions, other dimension listed on the website are of the packaging and not necessarily the product. The Conditions will be exclusively governed by and construed in accordance with the laws of South Africa whose Courts will have exclusive jurisdiction in any dispute, save that we have the right, at our sole discretion, to commence and pursue proceedings in alternative jurisdictions.

We reserve the right to change, modify, add to or remove from portions or the whole of these Terms and Conditions from time to time. Changes to these Terms and Conditions will become effective upon such changes being posted to this Website. It is the User’s obligation to periodically check these Terms and Conditions at the Website for changes or updates. The User’s continued use of this Website following the posting of changes or updates will be considered notice of the User’s acceptance to abide by and be bound by these Terms and Conditions, including such changes or updates.

Limited Warranty on Products

Ruggedize products carries a 12 month limited warranty, with all exclusions as stipulated by the manufacturer. All products sold by Ruggedize are guaranteed to be free from defects in the material and workmanship at the time of sale. The products are guaranteed to fit and perform on their intended applications, provided the vehicle has not been modified* or suffered structural damage. The warranty does not cover misuse of the light fixture, or re-wiring it from its original configuration, or installations done by an unauthorized or unqualified person. The warranty is only valid if the installation was done by an Auto Electrician or approved installers, and the presenting of installation proof of such installations.

If Buyer discovers a covered defect, Buyer should return the Product to the place of purchase.  The Product will be repaired or replaced at our discretion. That is the extent of our liability under this Warranty and, upon expiration of the applicable warranty period, all such liability shall terminate. We reserve the right to require proof of purchase for all warranty claims.

Warranty Exclusions:

We do not warrant Products against normal wear and tear, unauthorized modifications or alterations, improper use, improper maintenance, accident, misuse, negligence, damage to the product or paint (due to over-tightening of fasteners or a corrosive environment) or if the Product is used for a purpose for which it was not designed. Except for expressly stated in this Warranty, we shall not be liable for direct, indirect, incidental, or other types of damages arising out of, or resulting from the use of Product.  This Warranty is in lieu of all other warranties, express or implied, including, but not limited to, implied warranties of merchantability or fitness for a particular purpose. Product being imported or sold under specific request, will not be included under the Ruggedize warranty.

Make sure you measure and test fit the lights BEFORE any cutting, welding, or unnecessary bending is done. Once modified, the lighting fixture is NOT RETURNABLE. If you are unsure of the proper installation procedures, or fitting, please contact us at info@ruggedize.co.za. Please do not modify any Ruggedize lighting fixtures before talking with us about your installations because doing so will void your warranty.

All warranty claims must have a Return Authorization Number (see below) and will be reviewed by our claims team. At this point, it is our option to repair or replace the component. Ruggedize reserves the right to replace any product that has been discontinued, with a new product of comparable value, and functionality. Under no circumstances shall the warranty be transferable or assignable. Any and all costs to remove and / or replace a warranted product are not covered by this warranty, including the shipment to and from Ruggedize for the replacement. Also loss of vehicle, rentals, or towing, is not covered. Unfortunately our Ruggedize Kiddies products does not carry a warranty. Other than the warranty described above, all Ruggedize products are sold “AS IS” and no other warranty is implied. At any time, the terms of this warranty are severable.

Please note that our products are for off-road and outdoor use only, unless it is approved by your local roads authority for on-road use.

*Modifying the design or function, or subjecting this product to abuse, misuse, mishandling, or unauthorized repair, voids all aspects of the warranty or return policy.

Refunds / Returns Policy of Dealers

Any and all products purchased from an authorized Ruggedize dealer must be returned to the dealer. Please review your dealers return policy.

Refunds / Returns Policy of Ruggedize

Should you for any reason wish to cancel your purchase you will be liable for a 15% handling fee. Return / refund shipping is for the clients account. You must advise us in writing of your cancellation and any such cancellation must be signed by the person who made the original purchase. The goods must be returned to us undamaged in the original packaging within 5 calendar days. Only regular priced items may be refunded, unfortunately sale items cannot be refunded, no exceptions.

Return Authorization Number: All returns must be accompanied by a Return Authorization Number, original invoice, installer’s certificate or installation invoice and a statement regarding the return. To obtain a Return Authorization Number, please email info@ruggedize.co.za with your statement regarding the return. No returns will be accepted unless all the above documentation accompanies it. All non-warranty returns are subject to a 15% restocking fee, no exceptions. The consumer is responsible for any and all freight costs of a return as well as the shipment for exchange returns. Any products which have been modified*, cut, welded, bent, damaged, used on the vehicle are not subject to a return. No exceptions. Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund. If you are approved, then your refund will be processed, and a credit will automatically be applied to the original method of payment, within a certain amount of days.

*Modifying the design or function, or subjecting this product to abuse, misuse, mishandling, or unauthorized repair, voids all aspects of the warranty or return policy.

Late or missing refunds (if applicable): If you haven’t received a refund yet, first check your bank account again, next contact your bank. There is often some processing time before a refund is posted. If you’ve done all of this and you still have not received your refund yet, please contact us at info@ruggedize.co.za.

* Note:  Ruggedize (Pty) Ltd recommends that you use Speed Services Couriers (South African Postal Services) for all returns as it offers shipment tracking through a 24 hours customer helpline. Should you choose to use a carrier that does not offer a tracking facility and the goods are lost then no refund or return will be considered.

International customers should make use of a courier that offers:

1. Shipment tracking.

2. Insure your package for safe return and declare the full value of the shipment failing which loss or damage will be for your account.

Product Availability

Lead time is dependent on stock availability. Should we have stock available; orders will be dispatched within 48 hours provided payment is validated / received, which could take up to 3 days. Should the product not be in stock please allow 14 working days plus freight transit time. This will allow for manufacturing and delivery to our warehouse. Every effort is made to effect shipment of your order timeously however unforeseen circumstances may cause delays. Should we be faced with such an occurrence Ruggedize (Pty) Ltd will contact you via email and provide a revised shipping schedule. Unfortunately our suppliers have the right to change their product offering from time to time. If at the time of placing an order, the specific product selected is no longer available, we would contact and consult with you to recommend a similar product and negotiate the price difference, if applicable, according to the original selection.

Delivery Policy: When you click to make a purchase with us legal obligations arise and your right to refund of monies are limited by our terms & conditions. You must not make any purchase through this site unless you understand and agree all our terms and conditions. Once payment is made for the purchase, it is deemed that you have read and understood the terms and conditions for such purchase. Order Processing

Order processing will not begin until we receive a confirmed order and full payment.

Payment Options and Pricing

All transactions will be processed in South African Rands (ZAR). Ruggedize (Pty) Ltd endeavours to offer you competitive prices on current products; you’re total order price will include the price of the purchase plus any applicable sales tax and shipping charges (on the day of shipping).

Ruggedize (Pty) Ltd reserves the right to change pricing at any time without prior notice. Should Ruggedize (Pty) Ltd reduce its price on any shipped products within 10 working days of shipment, you may contact us and request a refund of the difference between the price you were charged and the reduced selling price. To receive the refund you must contact us within 14 days of shipment.

EFT (Electronic Fund Transfer)

One of the most widely used ways of sending money online. Once you have added your desired items to your shopping cart, proceed to “Checkout” and follow the order processing instructions. You will then have to load Ruggedize (Pty) Ltd as a beneficiary on your internet banking and use the unique Order Number (RUGG000) in the reference line for your payment. Shipping

Shipping is in RSA counter to counter. Please ensure the correct shipping address is provided from the outset as title and risk will pass to you once the order has left our premises. Ensure that an address is selected with someone that can accept delivery during working hours. Shipping cost is calculated per item on a flat rate depending on the size and volumetric weight of the products purchased. Once the packaged is collected for shipping, a tracking number will be provided via email, for tracking purposes. When a shipment is received damaged; the consumer must contact the carrier to start a damage claim.

Orders Outside RSA Borders

Any orders outside the RSA borders must be requested via email to info@ruggedize.co.za. Provide the full product description and code as well as the intended delivery address. We will forward you a quotation for the purchase and delivery cost. Payment will be done via PayPal. Refer to the Refunds / Returns Policy of Ruggedize

Undelivered Packages

Occasionally packages are returned to us undelivered. Should this event take place every attempt will be made to contact you to make arrangements for re-shipment.

Consent

I understand that all the designs and trademarks are registered to Ruggedize (Pty) Ltd and hereby accept the terms and conditions. I undertake not to copy/duplicate the trademarks and designs directly or indirectly in anyway and understand the legal implications thereof. Should I be found to be in violation of this agreement I understand that I will be held liable for all legal costs incurred by Ruggedize (Pty) Ltd for any civil action or any legal action deemed necessary against me.
